Complaints have been received from residents about what has been believed to be a Right of Way. The walkway between The Quays and Liverpool Road North has been blocked off as new owners have created a sales area for their fencing business. At its meeting in October, the Clerk was asked to investigate whether a right of way existed and if so, to ask Lancashire County Council to take action to reinstate it. At the time of going to press, it is clear that the route has in the past been used for access, but whether that usage amounts to having a right of way, or whether any there is any other legal right across the land, is not clear. The Parish Council would like to hear from people who have evidence supporting or not supporting it being a right of way, and if evidence is found that a right of way exists, Burscough Parish Council can ask that the route be dedicated under legislation contained in the Highways Act 1980 s31. This may be a lengthy process but there is a procedure in law to establish it one way or another.
